Processing of data in connection with the use of the service

Purposes and legal basis of data processing on the site

Use of the service

  1. We process the personal data of all persons using the Service (including: name, surname, postal address, email address, telephone number, IP address or other identifiers and information collected through cookies or other similar technologies) and who are not registered Users (i.e. persons who do not have a profile on the Service) for the following purposes:
    • the provision of services by electronic means with regard to making available to Users the content collected on the Website - in which case the legal basis for the processing is the necessity of the processing for the performance of the contract (Article 6(1)(b) RODO);
    • analytical and statistical - in which case the legal basis for the processing is our legitimate interest (Article 6(1)(f) RODO), consisting of conducting analyses of Users' activities as well as their preferences in order to improve the functionalities used and services provided;
    • possible establishment, investigation or defence of claims - the legal basis for the processing is our legitimate interest (Article 6(1)(f) RODO) to protect our rights;
    • marketing (ours and those of our trusted partners), in particular related to the presentation of behavioural advertising - the principles of processing personal data for marketing purposes are described in the "MARKETING" section.
  2. Your activity on the Website, including your personal data, is recorded in system logs. The information collected in the logs is processed primarily for purposes related to the provision of the Services. We also process it for technical, administrative purposes, for the purposes of ensuring the security of the IT system and the management of this system, as well as for analytical and statistical purposes - in this regard, the legal basis for processing is our legitimate interest (Article 6(1)(f) RODO).

Registration on the site

  1. When registering on the Website, you will be asked to provide the data necessary to create and operate your account. In order to facilitate handling, you may provide additional data, thereby giving your consent to its processing. Such data can be deleted at any time. The provision of data marked as mandatory is required in order to set up and operate your account and failure to do so will result in us being unable to set up your account. The provision of other data is voluntary.
  2. Your personal data is processed:
    • in order to provide services related to the maintenance and operation of an account on the Website - the legal basis for processing is the necessity of processing for the performance of the contract (Article 6(1)(b) RODO), and with regard to data provided on an optional basis - the legal basis for processing is consent (Article 6(1)(a) RODO);
    • for analytical and statistical purposes - the legal basis for the processing is our legitimate interest (Article 6(1)(f) RODO), consisting of conducting analyses of Users' activity on the Website and the way they use their account, as well as their preferences in order to improve the functionalities used;
    • for the purpose of possibly establishing, pursuing or defending against claims - the legal basis for the processing is our legitimate interest (Article 6(1)(f) RODO) in protecting our rights.

In the event that the Service enables you to log in via other portals (e.g. Facebook, Google, Instagram, Twitter, Apple), the Service will only collect the data necessary for registration and account operation from your account within the respective portal. By changing the settings of the plug-in yourself, you can easily extend the scope of the data collected to include such data as may be useful for the use of your account functionality on the Service.

Use of paid services on the site

  1. If you place an order (to purchase goods or services) on the Website, we will process your personal data for the following purposes:
    • for the purpose of fulfilling a submitted order - the legal basis for processing is the necessity of processing for the performance of the contract (Article 6(1)(b) RODO); for data provided on an optional basis, the legal basis for processing is consent (Article 6(1)(a) RODO);
    • in order to comply with statutory obligations incumbent on us, and arising in particular from tax and accounting legislation - the legal basis for the processing is a legal obligation (Article 6(1)(c) RODO);
    • for analytical and statistical purposes - the legal basis for the processing is our legitimate interest (Article 6(1)(f) RODO) to analyse your activity on the Website, as well as your shopping preferences in order to improve the functionalities used;
    • for the purpose of possibly establishing, pursuing or defending against claims - the legal basis for the processing is our legitimate interest (Article 6(1)(f) RODO) in protecting our rights.

Contact forms

  1. On the Website we provide you with the possibility to contact us using an electronic contact form. Using the form requires you to provide the personal data necessary for us to contact you and answer your question. You may also provide other data in the form to facilitate our contact or to handle your enquiry. Provision of data marked as mandatory is required in order to receive and handle your enquiry, and failure to do so will result in us not being able to handle your enquiry. The provision of other data is voluntary.
  2. The personal data you send us via the contact form are processed:
    • in order to identify you as the sender and to handle your enquiry sent via the form provided - the legal basis for the processing is the necessity of the processing for the performance of the service contract (Article 6(1)(b) RODO);
    • for analytical and statistical purposes - the legal basis for the processing is our legitimate interest (Article 6(1)(f) RODO), consisting of keeping statistics on queries made by Users via the Website in order to improve its functionality

Marketing

  1. We process your personal data in order to carry out marketing activities, which may consist of:
    • displaying marketing content that is not tailored to your preferences (contextual advertising);
    • displaying marketing content that matches your interests (behavioural advertising);
    • e-mail notifications of interesting offers or content, which in some cases contain commercial information (newsletter service);
    • carrying out other activities related to direct marketing of goods and services (sending commercial information by electronic means and telemarketing activities)
  2. In order to carry out marketing activities, we use profiling in some cases (if you have given your consent). This means that through automated data processing we assess selected factors about individuals in order to analyse their behaviour or make predictions for the future.

Contextual advertising

We process your personal data for marketing purposes in connection with targeting you with contextual advertising, i.e. advertising that is not tailored to your preferences. The processing of your personal data is then carried out in connection with the exercise of our legitimate interest (Article 6(1)(f) of the DPA).

Behavioural advertising

We and our trusted partners process your personal data, including personal data collected through cookies and other similar technologies, for marketing purposes in connection with targeting you with behavioural advertising, i.e. advertising that is tailored to your preferences. The processing of personal data then also includes profiling. The use of the personal data collected through this technology for marketing purposes, in particular for the promotion of services and goods of third parties, requires your consent, which you can withdraw at any time.

Direct marketing

Your Personal Data may also be used by us so that we can direct marketing content to you via various channels, i.e. by email, by MMS / SMS or by telephone. We only undertake such activities if you have given us your consent, which you can withdraw at any time.

Social networks

We process your personal data when you visit our profiles maintained on social media (Facebook, YouTube, Instagram, Twitter). This data is processed exclusively in connection with the running of the profile, including to keep you informed about our activities and to promote various events, services and products. The legal basis for the processing of your personal data for this purpose is our legitimate interest (Article 6(1)(f) RODO) in promoting our own brand.

Essential marketing techniques

  1. We use statistical analysis of website traffic, via Google Analytics (Google Inc., based in the USA). We do not transmit personal data to the operator of this service, only anonymised information. The service is based on the use of cookies on your end user device.   2. As part of the Service, we use the Facebook pixel. This technology means that Facebook (Facebook Inc., based in the USA) knows that a person registered with it is using the Service. In this case, it relies on the data in relation to which it is itself a controller. We do not pass on any additional personal data from you to Facebook. The service is based on the use of cookies on your terminal device.

We may use remarketing techniques that allow us to tailor advertising messages to your behaviour on the Service, which may give the illusion that your personal data is being used for tracking purposes, but in practice we do not pass any of your personal data to advertising operators. Period of processing of personal data

    • The right to obtain a copy of the data - on this basis, we will provide you with a copy of the processed data relating to the person making the request upon your request;
    • The right to rectification - at your request, we are obliged to rectify any inconsistencies or errors in the personal data processed and to complete it if it is incomplete;
    • The right to erasure - on this basis you can request the erasure of data whose processing is no longer necessary for any of the purposes for which they were collected;
    • The right to restrict processing - on this basis, we will, at your request, cease performing operations on your personal data - with the exception of operations to which you have given your consent - and their storage, in accordance with the retention rules adopted or until the reasons for restricting the processing cease to exist;
    • The right to data portability - on this basis - to the extent that your data is processed in connection with a contract or consent, we will release the data you have provided to us in a computer-readable format. You can also request that we send this data to another entity - provided, however, that we have the technical capacity to do so.
    • The right to object to processing for marketing purposes - you can object to the processing of your personal data for marketing purposes at any time, without having to justify your objection;

Recipients of data

  1. As we want to deliver the best possible service to you, we will disclose your personal data to our trusted partners, including, in particular, suppliers responsible for operating IT systems, entities such as banks and payment operators, accounting service providers, couriers (in connection with the fulfilment of your order), marketing agencies (for marketing services) and our affiliates.

Transfers of data outside the EEA
